I as a civilian defense counsel, who represents many military members, hate when my clients give a statement to the investigating authorities. Many times my clients don’t understand that some of the basic elements in proving a case are settled when they give a statement to the police. Something as simple as proving that you were there at the location that the crime occurred can be a fairly hard thing for prosecutors to prove at trial. If the police ask you, on the night of the crime, “where were you?” And you say “I was there.” The first element of the criminal offense has been proven.

This is what the investigators are trying to do; they are trying to prove each and every element of the criminal offense. Most of the time it is the accused person that proved themselves guilty.
